ChatGPT maker OpenAI faces class action over how it used people’s data
OpenAI, the company behind the popular chatbot ChatGPT, is facing a class-action lawsuit alleging that it violated the copyrights and privacy of millions of internet users by using their data without permission. The lawsuit argues that OpenAI scraped data from social media comments, blog posts, Wikipedia articles, and other sources to train its AI technology. The case raises questions about the legality of using publicly available data to train AI models and could set a precedent for how AI algorithms are trained and how people are compensated for the use of their data. The lawsuit adds to the growing list of legal challenges faced by companies in the AI industry. The key takeaway from the article is that the lawsuit against OpenAI highlights the need for clearer regulations and transparency around the use of data in AI development.
Our Take: While OpenAI already faces legal battles around specific issues like defamation or copyright issues surrounding Github’s reproduction of other code, this case marks a broader attempt to take legal action against the core of ChatGPT’s model. The field of AI law is newly emerging, with a need for stronger legal models and understanding of the technology, and ‘fair use’ claims may be difficult to evaluate in an environment where the technology’s inner workings are not fully transparent (this brief from the Congressional Research Service provides a helpful overview of how different AI models could violate certain requirements for claiming fair use). One thing that will be particularly interesting to observe is how the different parts of the legal claim play out: While the article primarily mentions data scraping as well as negligence causing harm to minors, the complaint filed also accuses OpenAI of violating unfair competition laws, and engaging in deceptive business practices. In the event that the court rejects some of these arguments and sustains others, the case may influence which fields of law take the lead in regulating AI.
‘It’s not like science fiction any more’: Nasa aiming to make spaceships talk
Nasa engineers are developing an AI interface that could allow astronauts to communicate with their spacecraft and mission controllers to converse with AI-powered robots on distant planets and moons. The AI, similar to ChatGPT, could be included on the Lunar Gateway space station as part of the Artemis program. The system would have a natural language interface, allowing astronauts and mission control to communicate with it easily. The AI would also be able to detect and possibly fix glitches and inefficiencies in real time. The goal is to have conversational interactions with space vehicles and receive alerts and interesting findings from them. The AI would also enable collaborative learning among robotic rovers on distant planets through federated learning, without the need to transmit large amounts of data back to Earth.
Our Take: This is yet another example of how quickly the latest advances in generative AI are being adopted and deployed in broader application areas. The technology adoption curve has been speeding up through the latest innovations, and generative AI seems to fit this trend. It’ll be interesting to see how NASA addresses the reliability concerns of generative AI when it comes to mission-critical applications.
OpenAI Plans ChatGPT ‘Personal Assistant for Work,’ Setting Up Microsoft Rivalry
OpenAI, the creator of ChatGPT, has revealed plans to transform the chatbot into a "supersmart personal assistant for work." This assistant would have knowledge about an individual and their workplace, enabling it to perform tasks like drafting emails or documents in the person's style and with up-to-date business information. This move puts OpenAI in potential competition with Microsoft, its primary business partner, as well as other OpenAI software customers like Salesforce, who also aim to develop AI assistants for work.
Our take: It’s clear that OpenAI thinks this is a good direction to pursue, but it’s hard to see how this would play out long term. By building and developing additional products on top of its models, OpenAI will be competing not only with its largest investor (Microsoft), but also with its customers (e.g. startups building on top of OpenAI API) as well. It’ll also be very easy to make the case that OpenAI is leveraging its customers’ data (seeing their API calls) to build its own products, and this could be a very tricky legal situation.
How the Great AI Flood Could Kill the Internet
The rise of AI-generated books on Amazon's bestselling lists highlights the potential threat to the online information ecosystem. While the quality of these books is poor, click farms are using bots to manipulate rankings and monetize the system. This is just the latest development in the relationship between humans and writing, from the exclusive access of the high class to the democratization of information through the printing press and the internet. However, the algorithmic feed and the emergence of AI tools have led to passive consumption of content, allowing for the proliferation of low-quality AI-generated content. This "Great AI Flood" could lead to the internet becoming a desert populated by AI bots, potentially causing the loss of high-quality content and the degradation of the online experience. The key takeaway is that our laziness and reliance on AI tools may have unintended consequences for the internet.
Our Take: The more that the internet is flooded with low-quality content, the more people will depend on algorithms to do the work of filtering for them. If LLMs or image generators are used to scrape web data, create new content, and feed it back into the web, there are likely to be compounding effects. One critique of this article is that it primarily attributes our growing reliance on algorithms to ‘human laziness’, overlooking how it may be a self-perpetuating feature inherent to these systems. It’s crucial to consider how we can design better technologies, regulatory schemes, and internet cultures that reward meaningful creation of and engagement with material, rather than pushing content for the sake of profit or lackluster ‘creativity’.
