Are you sure that a contract has to be written? A lot of people say so, but I wonder if they know what a contract really is by law. I hail a cab, and the cab driver agrees to ride me to a given place: there is a contract, althought there is no piece of paper. The legal definition of a contract does not require it always to be written (https://www.law.cornell.edu/wex/contract).

That's a fair point; still, most analysis I saw made the broader point there did not seem to be a clear contract in this case, written or unwritten.
